Premise Liability
The term "premise liability" generally refers to the liability of property owners or occupiers for accidents that occur at their “premises” or places they rent (home, store, office, shopping mall, etc.) because of their negligence or carelessness. Landowners and occupiers are generally required to maintain their premises in a safe condition that will not cause injury to visitors.
These laws apply to both business proprietors and homeowners, with businesses often times having even more stringent duties to provide a safe environment for its paying customers.
Some of the most common cases of premise liability are the following:
- Construction site accidents;
- Slip and fall incidents at commercial establishments such as malls, stores and supermarkets caused by solid, liquid and other foreign substances;
- Trip and fall incidents caused by unsafe property conditions including dangerous accumulations of snow and ice, uneven sidewalks and pavements and poorly marked hazards;
- Assault, battery or theft by employees or business patrons upon another person in or around said premises.
